Today, we're sharing some important reminders about appropriate union activity during work hours and workspaces. We've received a large number of queries on this topic and have tried to address the most important, pertinent questions below. We encourage you to read this message in its entirety.

Union Activity During Working Hours and in Work Spaces

Employees have the right to engage in protected union activity under Alaska鈥檚 Public Employment Relations Act (PERA), as administered by the Alaska Labor Relations Agency (ALRA). The University also retains the right to ensure that work is performed during working time and that operations are not disrupted.

As a general guideline:

  • Working time is time when an employee is expected to perform job duties. Union solicitation during working time may be restricted.

  • Non鈥憌orking time is time such as lunch, breaks, or before/after shifts. Union solicitation is generally permissible during non-working time, provided it does not disrupt operations and all employees involved are on non-working time.

Additionally, the distribution of union materials is generally not allowed in work areas, but is generally allowed in non-work areas. Work areas are spaces where University business is actively conducted, including but not limited to:

  • Offices, cubicles, and workstations
  • Classrooms and labs while in use
  • Service counters and reception areas
  • Copier/scanner rooms when employees are actively working

Non鈥憌ork areas generally include:

  • Break rooms and coffee areas
  • Areas around water coolers
  • Employee lounges
  • Parking lots
  • Hallways or spaces outside office doors or cubicles (when not interfering with work)

Any restrictions must be applied consistently and neutrally, consistent with all other rules regarding non-solicitation in the workplace, without regard to union affiliation or viewpoint. Supervisors should remain neutral, avoid interference or retaliation, and contact Labor & Employee Relations before addressing concerns about union鈥憆elated activity.
